WALTER SON OF WALTER CHESTHUNT, KNIGHT

461 Writ. St Alban ’s Abbey. 14 September 1440. [Louthe].

Addressed to Robert Large, mayor and escheator of London . The king is given to understand that Walter, son, was lately seised in demesne as of fee of 5 messuages in the parish of St Stephen Walbrook, held of the king in free burgage and, thus seised, in contravention of the statute of mortmain, alienated them without royal licence to Walter, son, not then freeman of the city. Inquire which Walter, son, was seised of the messuages in demesne as of fee and then alienated them, whether or not he was a freeman on the day of the alienation, to whom he alienated the messuages, by what authority, of whom they are held, by what service, and their value.

He was lately seised of the following in demesne as of fee.

St Stephen Walbrook, 5 messuages in ‘Bokeleresbury’ in the parish of St Stephen Walbrook in the ward of Cheap, annual value 25 marks, held of the king in free burgage as all the city is held.
Thus seised, by his testament containing his last will, proved, proclaimed and enrolled in the London Husting court of common pleas on 28 July 1382, he bequeathed the messuages, among other things, in mortmain to the then master of the house or hospital of St Thomas of Acre, London, his confreres, and their successors, without royal licence, against the statute. He afterwards died and a certain John Neell, master of the house or hospital of St Thomas of Acre, entered the messuages by virtue of the bequest, and holds and occupies them in the said manner and form. Walter, son, was not a freeman at the time of the bequest.
