Newton Surmaville . John held the 2 chambers and two parts of a house jointly with Margery lately his wife, now deceased, by virtue of an indented and tripartite charter of Henry Gilbert, chaplain , now deceased, and William Lutton of Yeovil, still living, described as Henry Gilberd, chaplain , and William Loketon of Yeovil. The charter, shown to the jurors, dated at Newton Surmaville on 13 October 1420, described them as all their lands, tenements, rents, services and reversions as in houses, curtilages, gardens and closes, meadows, pastures and common pastures, stanks, ponds, fisheries and water-courses, dovecots, hedges, ditches and vegetable-beds, with appurtenances. This was to have reverted to Henry and William and their heirs but, in the same charter, it was remaindered to Ralph Bret of Caundle Marsh in Dorset, esquire, now deceased, and Agnes lately his wife, still living, daughter of John and Margery, and the heirs of their bodies, to hold of the chief lord of the fee by due services. By virtue of this, John and Margery attorned to Ralph and Agnes during the lifetimes of Henry and William, and the reversion now belongs to Agnes. East Coker and Kingston Pitney. The meadow and cottages, etc., were held by grant of John Peny and John Trok to John, described as John Warmwelle , and Margery lately his wife and the heirs of their bodies. It was described as all their tenements, mills, lands, meadows, service rents and reversions of all their tenants when they occur, in the said vills. The land and tenements now belong, by virtue of the grant, to the daughters of John and Margery, described here as Alice, now the wife of Simon Blike and Agnes, who was the wife of Ralph Bryt, esquire , both still living. Alice is said to be aged 36 years and Alice 32.

He was lately seised of the following in demesne as of fee, which by an indented charter dated on 11 October 1420, he granted to Henry Gilberd, chaplain , and William Lutton of Yeovil and their heirs and assigns, to hold of the chief lord of the fee by due services. The charter, which was shown to the jurors, named him as John Warmwelle , son and heir of Roger Warmwelle , and specified all his lands, etc., as 472, with all appurtenances in Newton Surmaville of which Roger had died seised in demesne as of fee and which had descended to John by right of inheritance. Henry and William, by an indented charter dated on 12 October 1420, shown to the jurors, granted the same to John Warmwelle , called John Warmwelle , and Margery his wife as a free tenement to hold of the chief lord of the fee by due services for their lifetimes, reversion and remainder wholly to Henry and William and their heirs and assigns. By virtue of this, John and Margery were seised in demesne as of free tenement and, afterwards, by an indented and tripartite charter dated on 13 October 1420, Henry and William remaindered it to Ralph Bret of Caundle Marsh, esquire , now deceased, and Agnes lately his wife, still living, daughter of John and Margery, and the heirs of their bodies, to hold of the chief lord of the fee by due services, with successive remainders specified to the following: Agnes and the heirs of her body; Richard Peny and Alice his wife, daughter of John and Margery, and the heirs of their bodies; Alice and the heirs of her body; and the right heirs of John, called John Warmwelle , and their heirs and assigns, all to hold of the chief lord of the fee by due services. By virtue of this, John and Margery attorned to Ralph and Agnes, and afterwards Margery died. All three charters were dated at Newton Surmaville , and are said to have been made without the king’s licence.

Newton Surmaville by Yeovil, a messuage with curtilage and garden attached; a dovecot with curtilage attached; a cottage with garden attached; a toft with garden attached; 1/2 a carucate of land; and 88 a. pasture, worth 53s. 4d. yearly, held of the king in chief for 6s. 8d. annual rent, payable at Michaelmas.
The 2 chambers and two parts of a house specified in 471 and 472 are parcels of the above messuage. The whole belongs to Agnes, but William Bythemore, lately escheator , and Thomas Husee, current escheator , have occupied it and had all the profits since John’s death. He was lately seised of the following tofts, etc., in demesne as of fee, which, by an indented charter dated on 6 September 1425, he granted to Richard Lang and Thomas Druet and their heirs and assigns to hold of the chief lord of the fee by due services. The charter, which was shown to the jurors, was granted in the name of John Warmwelle and specified 2 ferlings of land in Newton Surmaville by Yeovil, one of which formerly belonged to John Glovere and the other to John Passeware . By virtue of this, Richard and Thomas were seised in demesne as of fee and, afterwards, by an indented charter dated on 10 September 1425, they granted the tofts, etc., to John, called John Warmwelle , and Joan [recte Margery] his wife, to hold as a free tenement for life, for a rose at Midsummer. The charter, which was shown to the jurors, likewise specified 2 ferlings of land in Newton Surmaville by Yeovil, one of which formerly belonged to John Glovere and the other to John Passeware . Afterwards, by an indented charter dated on 12 September 1425, they granted the rent of a rose together with the reversion of the tofts to Ralph Bret , son of Ralph Bret , now deceased, and Agnes his wife, daughter of John Warmwelle , and the heirs of Ralph the son’s body, to hold of the chief lord of the fee by due services, with successive remainders to Agnes and the heirs of her body, and the right heirs of John Warmwelle , both to hold of the chief lord of the fee by due services. By virtue of this, John and Joan attorned to Ralph. All three charters were dated at Newton Surmaville , and are said to have been made without the king’s licence. Afterwards, John died seised, jointly with Joan, still living, and Ralph died without an heir of his body.
Newton Surmaville, 2 tofts with curtilages and gardens attached, and 20 a. land, worth 6s. 8d. yearly.

Date of death and heirs as 472, except that the husbands of Alice and Agnes are not mentioned.
