ANNE WIDOW OF FULK FITZWARYN

Writ Head

132 Writ de dote assignanda 24 July 1413. [Mapilton].

Recites the assignment of 1408 [CIPM XIX, no. 483]. William Clynton, who married Anne, and Anne herself, complain that she is insufficiently dowered because the assignment, made in general words as given above, is not properly valid (satis valida non existit) so that ... distrain for non-payment of rents not assigned in special; and William and Anne do not have any notice of their tenants ... so that the ministers of the other two parts of the lordships ... profits pertaining to William and Anne by reason of her dower. Order for assignment to be made parcel by parcel or, with the assent of the parties, in gross and by metes and bounds (parcellatim vel de assensu partium in grosso` et per metas et bundas) and with the names of tenants.

Both writ and assignment are partly illegible, but it seems a more specific assignment than had been made in 1408, one which should specifically identify the lands assigned to her, was ordered. In the inquisition held after her death (CIPM XXI, no. 631) she was found to hold more in dower than was assigned in 1408.

Broghton, ?Bokenhull, ...anyate, W..las, Falfeld, and Foukesmore with meadow, moor, except for the fishery of ?Longbuissh all the land and meadow pertaining to the farm of Newton the meadows of Ebnall medewe and ....dewe the mill of Henlle with stank and fisheries called ‘Newemullepole’ ... in the vills, viz. ?Little Fernhill/?Ebnall, ?Great Fernhill, Jor’, Henlle, Hindford, ?Old Marton, Upper Berghill, Lower Berghill .. profits of free and neif tenants. 1/3 moor of Perrymoor in the east part of the same by metes and bounds 1/3 forest of Babbinswood viz. a parcel beginning at le Greneputtes, across to Perrymoor, in the east part of the same forest. perquisites of court ... with ‘wayf’ and ‘stray’ ... 1/3 fold for beasts (averiis), in the east part of the same 2.. Feb. Redcastle. ...hamlet of Kenstone ... 1/3 park, by metes and bounds, in the east part of the same 2... Feb. Edgmond. ... Pickstock and Little Hales, with rents and services of all tenants in the hamlets ... ...perquisites of court with ‘wayf’ and ‘stray’ in those hamlets and all the above lands... ...issues from 15 Feb. 1408 when assignment was first ordered
